质量上都取得了空前的快速进步，中国已进入了世界能源大国的行列。然而在能源开发和利用的生命周期过程中，从能源资源的开采、加工和运输，到二次能源的生产（发电），以及电力的传输和分配，直至能源的最终消费，各阶段都会对环境造成压力，引起局部的、区域性的、乃至全球性的环境问题。我国长期以来对能源的安全供应非常重视，相对来说忽视了能源发展对环境所产生的负面影响，导致环境问题日益严重。随着我国全面建设小康社会步伐的加快，对能源生产和能源消费会有更高的要求，能源需求的持续快速增长必将使我国的环境保护面临更加沉重的压力。由能源开发利用导致的能源环境问题既是我国当前面临的现
实问题，也是影响我国长远发展的战略问题，是我国实现可持续发展的基础和重要保障之一。法律作为现代社会最权威、最有效的社会调整方式，在此问题的解决上理应发挥重要作用。因此，研究我国的能源环境问题，并在立法中进行恰当规制，对我国能源与环境保护事业无疑具有重要的现实意义。
一、能源开发利用对环境的不利影响
人类利用能源的历史已非常久远，能源对人类发展的巨大贡献是显而易见的。在产业革命以前的漫长岁月中，能源消费以薪柴为主，由于消费量不大，一方面植物的自然生长足以补充其作为能源的消费，另一方面环境容量可以“吸收和消化”薪柴利用过程中排放的'废弃物，因此，能源开发利用的环境影响基本上不成为问题。当时的环境问题主要是由于人口增长导致过度开垦造成的土质退化问题。产业革命促使矿物能源取代薪柴成为能源消费的主体，现代环境问题随之产生。经济、人口高速增长导致能源消费需求急速增长，人类赖以生存和发展的环境逐步恶化。总体而言，所有能源，包括可再生能源的开发利用，都会对环境产生不同程度的不利影响。
1、煤炭的开发利用对环境的不利影响。煤炭在开采过程中会造成矿山生态环境的破坏, 威胁生物栖息环境。主要包括对地表的破坏、引起岩层的移动、矿井酸性排水、煤矸石堆积、煤层甲烷排放等。煤炭消费过程中产生大量二氧化硫、二氧化碳 、氮氧化物、一氧化碳、烟尘和汞等污染物,是造成大气污染和酸雨的主要原因。煤炭消费过程也排放温室气体,造成全球性环境问题。
2、石油和天然气勘探开采和加工利用对环境的不利影响。油田勘探开采过程中的井喷事故、采油废水、钻井废水、洗井废水、处理人工注水产生的污水的排放；气田开采过程中产生的地层水, 含有硫、卤素以及锂、钾、溴、铯等元素,其主要危害是使土壤盐渍化；油气田开采过程中的硫化氢排放；炼油废水、废气(含二氧化硫、硫化氢、氮氧化物、烃类、一氧化碳和颗粒物)、废渣（催化剂、吸附剂反应后产物）排放；海上采油影响海洋生态系统,石油因井喷、漏油、海上采油平台倾覆、油轮事和战争破坏等原因泄入海洋，对海洋生态系统产生严重影响；在交通运输业，机动车尾气等造成大气污染，排放一氧化碳、碳氢化合物、氮氧化物、铅等污染物；等等。
